Terms of Service

Agreement

These Terms govern your use of Empowered Man, operated by Empowered Man LLC, 2200 E Williams Field Rd, Suite 200, Gilbert, AZ 85295 (“we,” “us”), including our websites, assessments, emails, text messages, calls, and any coaching program you purchase (together, the “Services”). By using the Services you agree to these Terms. If you do not agree, do not use them.

You must be 18 or older to use the Services.

What this is, and what it is not

Empowered Man provides coaching and education. It is not therapy, counseling, medical care, psychiatric care, or mental health treatment, and it is not a substitute for any of those. Our coaches are not acting as your licensed therapist, physician, attorney, or financial advisor, and no therapist-client or doctor-patient relationship is created. We are not bound by clinical confidentiality rules such as HIPAA.

If you are experiencing a mental health crisis, or thinking about harming yourself or someone else, call or text 988 (Suicide and Crisis Lifeline), call 911, or go to your nearest emergency room. Do not rely on the Services in an emergency.

No guarantee of results

We do not promise or guarantee any outcome for your marriage, your relationship, or your life. Nothing on our sites, in our assessments, in our emails, or said on a call is a prediction or a guarantee. Results depend on your circumstances and your own actions, and on other people whose choices neither you nor we control.

Anything another client says about their experience is their experience. It is not a promise that you will get the same outcome, and it is not typical by default.

The assessment

Our marriage assessment is an educational self-reflection tool. It is not a diagnostic instrument and it has not been clinically validated. Its scores describe the answers you gave, nothing more. Use them as a starting point for thinking, not as a verdict on your marriage.

Acceptable use

You agree not to:

• Use the Services for anything unlawful, harassing, abusive, or fraudulent
• Give false information or impersonate anyone
• Record a call or a group session without our written permission
• Share, resell, or republish our materials, or give another person access to a program you paid for
• Attempt to gain unauthorized access to our systems, or interfere with them or with another user
• Scrape, crawl, or harvest information from the Services by automated means

We may suspend or end your access if you break these rules, and in a group setting we may remove you to protect other members.

The coaching relationship

If you buy a coaching program, the specifics of what is included — sessions, duration, materials, and access — are what we describe to you at the time of purchase. You are responsible for your own decisions and actions during and after the program. You should keep working with any licensed professional you already see; nothing we do replaces that care.

Payment and refunds

Prices are shown before purchase and are in US dollars. By purchasing you authorize us and our payment processor to charge the payment method you provide. Where a program is billed in installments, you authorize each scheduled charge, and you remain responsible for the full amount unless we agree otherwise in writing.

Refunds: You may request a full refund within 7 days of purchase if you have not yet attended a coaching call. After your first call, or after 7 days, whichever comes first, payments are non-refundable. If you are on a payment plan, you may cancel future installments at any time by emailing support@empoweredman.co. Installments already paid are not refunded.

Chargebacks filed without first contacting us may result in your access being suspended while the dispute is resolved.

Intellectual property

We own the Services and everything in them, including the assessment, its questions and scoring, our frameworks, worksheets, recordings, written materials, the Empowered Man name, and our logo. You get a personal, non-transferable, non-exclusive license to use the materials for your own development for as long as your access lasts. You may not copy, distribute, or create derivative works from them, or teach them as your own.

Anything you send us — feedback, suggestions, testimonials — may be used by us to operate and improve the Services. If we want to quote you publicly, we will ask first.

Third-party services

The Services rely on third parties for hosting, payments, scheduling, email, text messaging, video calls, and community software, and may link to sites we do not control. We are not responsible for those third parties or the content of sites we link to.

Privacy

Our Privacy Policy explains what we collect and how we use it, and is part of these Terms.

Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any information in them is complete or current.

Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or relationships, arising out of your use of the Services. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your use of the Services or your breach of these Terms.

Dispute resolution

Talk to us first. Before starting any formal proceeding, email us at support@empoweredman.co and give us 30 days to resolve it. Most things get sorted here.

If that does not resolve it, any dispute will be settled by binding individual arbitration rather than in court, except that either party may bring a claim in small claims court. You and we each waive the right to a jury trial and to participate in a class action. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and may take place in your home county or remotely.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

Changes

We may update these Terms. We will post the new version here and update the effective date. Continuing to use the Services after a change means you accept it.
